NFI Apartment Management, L.L.C. v. Third Coast Insurance Company, affirms summary judgment for a property insurer on the ground that the insured’s claims were time-barred.
After a May 2020 hailstorm, NFI submitted a claim on its apartment complex. On July 21, 2020, Third Coast denied payment because the estimated loss ($37,058.29) did not exceed the policy deductible ($359,856.60), but invited NFI to submit information that might lead it to reconsider.
NFI submitted an engineer’s report, the parties reinspected, and on July 28, 2021 Third Coast said it would “proceed with closing [the] file.”
NFI filed suit on July 23, 2024. The Fifth Circuit affirmed the dismissal of the claim on limitations grounds, applying the contractual limitations period of two years and a day, and concluding that limitations began to run on July 21, 2020 with an unambiguous claim denial, and had certainly run by July 2021.
